Terms of Service

These Terms of Service (“Terms”) govern your use of Bubbled, an iOS app developed by Jose Sanchez (“we,” “us,” “our”), based in the United States. By installing or using Bubbled, you agree to these Terms.

License to use

We grant you a personal, non-exclusive, non-transferable license to install and use Bubbled on devices you own or control, in accordance with Apple’s standard App Store license terms.

Eligibility

Bubbled is rated for ages 4 and up by the App Store in most regions (12+ in Brazil, All Ages in South Korea) and is not specifically directed at children. If you are a minor in your jurisdiction, please use Bubbled with a parent or guardian’s permission. We do not knowingly collect personal information from children under 13 — see our Privacy Policy for details.

User representations

By using Bubbled, you represent and warrant that: (1) you have the legal capacity to agree to these Terms; (2) you will not access Bubbled through automated or non-human means (bots, scripts, scrapers); (3) you will not use Bubbled for any illegal or unauthorized purpose; and (4) your use of Bubbled will not violate any applicable law or regulation.

Apple’s role

These Terms are between you and Bubbled, not Apple. Apple is a third-party beneficiary of these Terms and may enforce them against you as a user. Apple has no obligation to provide maintenance or support for Bubbled, and is not responsible for product warranties, claims of intellectual-property infringement, or compliance with consumer-protection laws — those are our responsibility, not Apple’s.

Subscriptions and purchases

Bubbled offers optional Pro subscriptions that unlock additional features, plus optional Tips to support development.

Pro subscription tiers:

• Bubbled Pro Weekly — 1 week, billed weekly
• Bubbled Pro Monthly — 1 month, billed monthly
• Bubbled Pro Annual — 1 year, billed annually

For all subscription tiers:

• Payment: charged to your Apple ID at confirmation of purchase. Prices vary by App Store storefront and are shown before you confirm.
• Auto-renewal: subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the end of the current period
• Renewal charge: your account is charged for renewal within 24 hours prior to the end of the current period
• Managing your subscription: open the App Store app → tap your profile → Subscriptions → Bubbled → Cancel, or go to Settings → Apple ID → Subscriptions

Tips: Bubbled offers optional one-time Tips at small, medium, and large amounts to support development. Tips are non-refundable, one-time purchases processed through Apple’s In-App Purchase system. Tips do not unlock features or content; they are voluntary contributions.

Refunds are handled by Apple. We do not process refunds directly.

Your content

You own the photos, videos, GIFs, captions, and other content you create with Bubbled. We do not claim ownership of your content. Because all content stays on your device, we do not hold or transmit it.

Acceptable use

You agree not to use Bubbled to:

• Create or distribute content that is illegal, defamatory, infringes others’ rights, or violates Apple’s App Store policies.
• Reverse-engineer the app or attempt to extract proprietary assets (bundled fonts, ink shaders, etc.).
• Use the app in any way that could harm minors.

Termination

We may suspend or end your access to Bubbled if you violate these Terms. You may stop using Bubbled at any time by uninstalling the app. Sections that by their nature should survive termination — such as intellectual property, limitation of liability, and governing law — survive.

No warranty

BUBBLED IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

Limitation of liability

IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR OTHER DAMAGES — ARISING FROM YOUR USE OF BUBBLED, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM. CERTAIN STATE AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSIONS OF DAMAGES; IF THESE APPLY, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of: (1) your use of Bubbled; (2) your violation of these Terms; (3) your violation of any third party’s rights, including intellectual property rights; or (4) any harmful act by you toward any other person.

Governing law

These Terms are governed by the laws of the operator’s state of residence, United States. Disputes will be resolved in the courts of that jurisdiction.

Open-source software

Bubbled bundles several open-source fonts and libraries. Full acknowledgements (including license texts where required) are available inside the app at Account → Acknowledgements.

Miscellaneous

These Terms (together with our Privacy Policy) are the entire agreement between you and us. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of that right. We may assign these Terms; you may not.

Changes to these Terms

If we change these Terms, we’ll update the “Last updated” date and, where appropriate, notify users within the app. Continued use of the app after changes means you accept the updated Terms.
